1. These Terms of Use Are a Contract Between You and Us
A. Binding Contract. These Terms of Use (this “Agreement”) are a legally binding contract between you and BEL Animation, a company dedicated to producing animated content and operating the Site at belanimation.com (together, “we,” “us,” or “BEL Animation”). Other than as expressly stated herein, there are no third‑party beneficiaries to this Agreement.
B. Agreement. You represent that you have read, understood, and expressly agree to be bound by this Agreement—including all terms, conditions, and notices referenced herein—whether or not you have created an account with us. If you do not agree, please do not use or access the Site or our services.
C. Supplemental Terms. This Agreement applies generally to your use of belanimation.com. Specific features—such as contests, submissions, streaming services, or event registrations—may be subject to additional terms. In the event of a conflict, those supplemental terms will govern. If you do not accept the supplemental terms, you may not use that feature.
D. Amendments. We may update this Agreement at any time. Material changes will take effect 30 days after we notify you or post the updated terms on the Site. You are responsible for reviewing this Agreement periodically. Continuing to use the Site beyond that date means you accept the changes. Our customer support is not authorized to modify this Agreement.
E. Accounts. Some services may require an account. You agree that all registration information you provide is accurate and complete, and that you will maintain it. You may not impersonate anyone or create an account for anyone other than yourself without permission. We may verify the information you provide.
F. Passwords and Security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
G. Electronic Notice. You agree to receive electronic communications (e.g., agreements, notices) from us via the email address you provided. These communications satisfy any legal requirement that such notices be in writing.
H. Termination or Suspension. We may suspend or terminate your access to the Site or services at any time if you violate this Agreement—without notice—and certain terms (e.g., indemnity, governing law) will still apply.
2. License Grant & Restrictions – Content & Use
All content on belanimation.com—including animations, videos, graphics, music, art, scripts, text, software, and designs (“Content”)—is owned or licensed by BEL Animation and protected by copyright, trademark, and intellectual property laws.
A. Limited, Personal License. We grant you a limited, non-exclusive, non-transferable license to access and view the Content for your personal, non-commercial use only, and only as long as the Content is available to you under this Agreement.
B. Restrictions.You may not:
• Circumvent any digital rights or content protection;
• Copy, reproduce, distribute, publicly display, or perform Content (except as expressly permitted);
• Create derivative works or modify Content;
• Reverse-engineer, decompile, or disassemble any software associated with the Content;
• Remove or obscure copyright/trademark notices;
• Use the Content in association with commercial or promotional activity without prior written permission;
• Use automated tools (such as bots or scrapers) to access or extract Content;
• Use the Content in connection with creating, training, or enhancing any artificial intelligence or machine learning tools, unless expressly permitted.
Any attempt to violate these restrictions is a breach of this Agreement.
C. Export Controls. You must comply with applicable export laws and economic sanctions. You represent that use of the Content will not violate these laws.
3. Usage Rules & Site Access
A. Site Changes. We continuously update and evolve the Site and Content. We may alter or discontinue any part of the Site or services at any time.
B. Third-Party Integration. The Site may link to or integrate with third-party sites or services (e.g., Vimeo, social media platforms). We do not control them and are not responsible for their terms or practices. Your use of those third parties is subject to their terms.
C. Technical Requirements. You may need certain hardware, software, or internet speed to access some features. You are responsible for meeting minimum requirements.
D. Mobile Network Use. If you access the Site via mobile, standard data or messaging rates may apply.
E. Communications Consent. You may opt-in to receive updates, notifications, or promotional messages. Standard rates may apply. You can opt out at any time through unsubscribe options.
F. App Permissions. If you use mobile apps, you may grant us device permissions (like storage or notifications). By using the app, you also agree to automatic updates.
G. Entertainment and Informational Use Only. The Site and Content are for personal use only. They do not constitute professional advice (legal, medical, financial, etc.).
H. Prohibited Commercial Use. Unless expressly permitted, you may not use the Site or Content for commercial, marketing, sponsorship, or promotional purposes.
I. Malware. Do not upload or distribute harmful code or interfere with other users’ access.
4. Paid Content, Transactions & Subscriptions (if applicable)
If you purchase content or services via belanimation.com:
A. Seller Identity. Sales will be made by BEL Animation or an authorized seller specified at the time of purchase.
B. License for Digital Content. Purchasing digital content grants you a limited license only. Content is non-transferable, non-refundable, and may not be used outside the platform as permitted.
C. Subscription Services. Subscriptions may auto-renew. We will notify you before renewal and you have the right to cancel at any time. No prorated refunds are offered unless otherwise stated.
D. Order Process & Cancellation. You will have an opportunity to review and confirm your order before purchase. Once the order is accepted, the contract is binding. We reserve the right to cancel an order for reasons including availability, pricing errors, or fraud risk. Refunds will be issued if cancellation occurs after payment.
E. Payments & Billing. By providing payment details, you represent those details are accurate and authorized. We may use third-party services to update payment card information.
F. Right to Cancel / Returns (if physical goods): You may cancel orders for physical goods within 30 days, subject to conditions (item unused, in original packaging, etc.). Non-returnable items may include sealed digital media or personalized items. Return shipping may be your responsibility.
5. Contests, Promotions & Submissions
A. Promotions. Contests or promotions may include additional official rules. If there is a conflict, those rules control.
B. Submissions & Creative Ideas. We do not accept unsolicited creative materials (e.g. story ideas, character concepts). Any such materials submitted may be deleted without review. Submitting any content does not create any obligation for us.
C. User-Generated Content. If the Site allows you to post content like comments, artwork, testimonials, or entries, you represent that:
• The content is lawful and does not violate any rights.
• You grant BEL Animation a non-exclusive, royalty-free, worldwide, sublicensable, irrevocable license to use, reproduce, adapt, publish, and distribute your content across any media now known or hereafter developed.
• You waive any rights to attribution, combined with moral rights to the extent permitted.
We may remove or refuse to publish any content at our discretion.
6. Disclaimers and Limitations of Liability
The Site and Content are provided “AS IS” and “AS AVAILABLE”. To the fullest extent permitted by law:
• We disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, or non-infringement.
• We are not liable for any damages resulting from your use or inability to use the Site, including lost data, profitability, or business interruption.
• Our total liability for any claim shall not exceed $1,000 USD, unless prohibited by applicable law.
7. Indemnification
You agree to indemnify and hold harmless BEL Animation and its officers, employees, affiliates, and partners against any claims, losses, liabilities, or expenses (including attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any third-party right.
8. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
A. Agreement to Arbitrate. To the fullest extent permitted by applicable law, you and BEL Animation agree to resolve any and all disputes or claims relating to your use of belanimation.com, our services, content, or these Terms of Use (each, a “Dispute”), through final and binding arbitration, rather than in court.
This means that you and BEL Animation are waiving the right to a trial by jury or to participate in a class action.
B. Exceptions to Arbitration. You and BEL Animation agree that the following Disputes are not subject to arbitration and may be brought in a court of law:
C. Arbitration Process.
• The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• The arbitration will be held in the county where you reside, unless the parties agree otherwise.
• If the claim is for $10,000 or less, either party may choose to have the arbitration conducted by telephone, video, or solely based on written submissions.
• The arbitrator shall have exclusive authority to resolve any Dispute, including those related to the interpretation, enforceability, or scope of this arbitration agreement.
D. Class Action Waiver. To the fullest extent permitted by law, you and BEL Animation agree that each may bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
E. Opt-Out of Arbitration. If you do not wish to be bound by this arbitration clause, you must notify us in writing within 30 days of your first use of the Site or acceptance of these Terms.
To opt out, send an email to:
Subject line: “Arbitration Opt-Out – [Your Full Name]”
Your opt-out notice must include your full name, address, and a clear statement that you wish to opt out of arbitration. This is the only way to opt out of this binding arbitration clause. Opting out will not affect the rest of the Terms of Use.
F. Enforceability. f any provision of this Section 8 is found to be unenforceable, that provision shall be severed and the remainder of the arbitration agreement shall remain enforceable.
9. Additional Terms
A. Severability. If any part of this Agreement is found invalid, it will not affect the remaining provisions.
B. Survival. Provisions intended to survive termination—such as license restrictions, disclaimers, indemnity, and dispute resolution—will continue to apply after termination of this Agreement.
C. Waiver. No failure or delay in enforcing any term shall waive BEL Animation’s rights. A waiver of one provision is not a waiver of the entire Agreement.
